{"id":1341,"date":"2012-04-04T19:00:46","date_gmt":"2012-04-04T19:00:46","guid":{"rendered":"https:\/\/drugpolicy.ca\/?p=1341"},"modified":"2016-03-01T21:44:12","modified_gmt":"2016-03-01T21:44:12","slug":"insite-resiste-au-test-des-traites-internationaux-relatifs-au-controle-des-drogues","status":"publish","type":"post","link":"https:\/\/mail.canadiandrugpolicy.ca\/fr\/insite-resiste-au-test-des-traites-internationaux-relatifs-au-controle-des-drogues\/","title":{"rendered":"Insite r\u00e9siste au test des trait\u00e9s internationaux relatifs au contr\u00f4le des drogues"},"content":{"rendered":"<p>Lors de la 55<sup>e<\/sup> assembl\u00e9e de la Commission des stup\u00e9fiants tenue \u00e0 Vienne du 12 au 16 mars, Damon Barrett, sp\u00e9cialiste des droits de la personne \u00e0 <a href=\"http:\/\/www.ihra.net\/\" target=\"_blank\">Harm Reduction International<\/a>, a parl\u00e9 candidement lors de la s\u00e9ance pl\u00e9ni\u00e8re des \u00e9nonc\u00e9s erron\u00e9s avanc\u00e9s par l\u2019Organe international de contr\u00f4le des stup\u00e9fiants (OICS) dans son <a href=\"http:\/\/www.incb.org\/incb\/fr\/annual-report-2011.html\" target=\"_blank\">r\u00e9cent rapport annuel<\/a> (2011) au sujet du centre d\u2019injection supervis\u00e9 de Vancouver, Insite.<\/p>\n<p>Au paragraphe 437 du rapport, l\u2019OICS indique clairement\u00a0: \u00ab\u00a0\u2026 les structures d\u2019injection et de consommation de drogues o\u00f9 la possession et l\u2019usage de drogues illicites sont tol\u00e9r\u00e9s ne sont pas conformes aux conventions internationales relatives au contr\u00f4le des drogues.\u00a0\u00bb C\u2019est une fausset\u00e9 criante, et le propre conseil juridique du Programme des Nations Unies pour le contr\u00f4le international des drogues, nomm\u00e9 en 2002, l\u2019admet. <a href=\"\/wp-content\/uploads\/2012\/04\/INCB-legal-brief.pdf\" target=\"_blank\">On peut le lire ici<\/a> (en anglais).<\/p>\n<blockquote><p><strong>Le fait que l\u2019OICS claironne encore cette fausse information dix ans apr\u00e8s que l\u2019opinion juridique de l\u2019ONU a \u00e9t\u00e9 sollicit\u00e9e tourne en d\u00e9rision l\u2019int\u00e9grit\u00e9 et la cr\u00e9dibilit\u00e9 de l\u2019OICS.<\/strong><\/p><\/blockquote>\n<p>Voici le paragraphe fautif du rapport de l\u2019OICS :<\/p>\n<p>437. En septembre 2011, la Cour supr\u00eame du Canada a rendu une d\u00e9cision sur l\u2019applicabilit\u00e9 de la loi r\u00e9glementant certaines drogues et autres substances \u00e0 un centre d\u2019injection de drogues supervis\u00e9 de Vancouver. Ce dernier \u00e9tait autoris\u00e9 \u00e0 op\u00e9rer en vertu d\u2019une exemption pour des \u00ab\u00a0raisons scientifiques ou m\u00e9dicales\u00a0\u00bb accord\u00e9e par un gouvernement pr\u00e9c\u00e9dent. La Cour supr\u00eame a rejet\u00e9 la d\u00e9cision du Gouvernement, qui avait refus\u00e9 de prolonger l\u2019exemption dont b\u00e9n\u00e9ficiait le centre d\u2019injection, l\u2019autorisant ainsi \u00e0 continuer d\u2019op\u00e9rer. L\u2019OICS rappelle qu\u2019en vertu du droit international, les dispositions du droit national ne peuvent \u00eatre invoqu\u00e9es pour justifier le non-respect des trait\u00e9s internationaux relatifs au contr\u00f4le des drogues auxquels un \u00c9tat est partie. Il rappelle en outre sa position selon laquelle les structures d\u2019injection et de consommation de drogues o\u00f9 la possession et l\u2019usage de drogues illicites sont tol\u00e9r\u00e9s ne sont pas conformes aux conventions internationales relatives au contr\u00f4le des drogues auxquelles le Canada est partie.<\/p>\n<p>Damon Barrett a donn\u00e9 l\u2019heure juste \u00e0 l\u2019OICS avec cette d\u00e9claration\u00a0:<\/p>\n<p><em>La r\u00e9cente <\/em><a href=\"http:\/\/scc.lexum.org\/fr\/2011\/2011csc44\/2011csc44.html\" target=\"_blank\"><em>d\u00e9cision de la Cour supr\u00eame du Canada<\/em><\/a><em> sur le centre d\u2019injection supervis\u00e9 de Vancouver est critiqu\u00e9e comme \u00e9tant contradictoire \u00e0 l\u2019article 27 de la Convention de Vienne sur le droit des trait\u00e9s, qui dit que le droit national ne peut \u00eatre invoqu\u00e9 pour justifier <\/em><em>le non-respect des obligations des trait\u00e9s internationaux<\/em><em>. Ce qui est exact. Mais la cause de la Cour supr\u00eame du Canada a \u00e9t\u00e9 d\u00e9cid\u00e9e selon la <\/em><a href=\"http:\/\/laws-lois.justice.gc.ca\/fra\/Charte\/\" target=\"_blank\"><em>Charte canadienne des droits et libert\u00e9s<\/em><\/a><em>, un document constitutionnel. Comme le sait l\u2019OICS, l\u2019article 3(2) de la Convention de 1988 relatif \u00e0 l\u2019obligation de criminaliser la possession pour usage personnel est assujetti aux principes constitutionnels des \u00c9tats qui sont parties. Une formulation semblable est utilis\u00e9e relativement aux dispositions p\u00e9nales de la Convention unique de 1961. En outre, en 2002, le contentieux du PNUCID a d\u00e9clar\u00e9, dans une opinion en la mati\u00e8re, que de telles interventions ne violent pas les conventions.<\/em><\/p>\n<figure id=\"attachment_1251\" aria-describedby=\"caption-attachment-1251\" style=\"width: 300px\" class=\"wp-caption alignright\"><a href=\"https:\/\/drugpolicy.ca\/wp-content\/uploads\/2012\/04\/UN-in-Vienna.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-1251 size-medium\" src=\"https:\/\/drugpolicy.ca\/wp-content\/uploads\/2012\/04\/UN-in-Vienna-300x184.jpg\" alt=\"UN-in-Vienna\" width=\"300\" height=\"184\" \/><\/a><figcaption id=\"caption-attachment-1251\" class=\"wp-caption-text\">Vienne<\/figcaption><\/figure>\n<p><em>\u00c0 ce titre, il n\u2019y a pas de conflit entre la d\u00e9cision de la Cour supr\u00eame du Canada et les conventions relatives au contr\u00f4le des drogues. Cependant, l\u2019analyse de l\u2019OICS de la cause ne se r\u00e9f\u00e8re pas aux dispositions des trait\u00e9s ni \u00e0 l\u2019opinion du PNUCID. Nous aimerions que l\u2019OICS clarifie son point de vue sur la d\u00e9cision de la Cour supr\u00eame du Canada \u00e0 la lumi\u00e8re de ces conditions des conventions relatives au contr\u00f4le des drogues, et son avis sur l\u2019opinion du PNUCID de 2002.<\/em><\/p>\n<p>\u00c0 l\u2019honneur du Canada, la d\u00e9l\u00e9gation canadienne s\u2019est \u00e9galement exprim\u00e9e et a laiss\u00e9 savoir \u00e0 la s\u00e9ance pl\u00e9ni\u00e8re que le Canada respectait vraiment toutes les exigences des trait\u00e9s internationaux relatifs au contr\u00f4le des drogues.
